Loaned images remain our property and must be returned in mint condition by the agreed date and under the terms and conditions specified on the order and the delivery note.
The terms and conditions of the loan are set out on the delivery note or order form, which also specifies the copyright fee payable for non-exclusive and clearly-defined use of the images.
Our clients are required to respect our moral rights to our photographs.
Our prior written consent is required for any manipulation whatsoever of our images.
No digital copy of more than 72 dpi resolution may be made of any of our images without our prior written consent. Any digital version of our images sent electronically as a sample may only be used for 60 days from the date of reception and must then be destroyed.
The user of our images assumes full responsibility for obtaining any authorisations required for using an image of the objects or persons shown and for any text or captions that accompanies the images.
A clear and unequivocal printed acknowledgement of Bastin & Evrard is required for each image. If such an acknowledgement is not made, the client will pay compensation equal to 100% of the SOFAM rights for each image.
The client will pay compensation equal to 200% of the SOFAM rights for any unauthorised use of our images.
The user agrees to provide us with two sample copies of any publication featuring our images as soon as possible after the publication date.
Our images may not be passed on to Third Parties without our prior written authorisation.
Our images may not be copied, by any process whatsoever, without our prior written authorisation.
We reserve all rights to our images, except when we, or SOFAM, have agreed to cede our rights to specific images in writing in return for an agreed payment.
The copyright of Bastin & Evrard is separate from the copyright of any architect or artist, or their legally-appointed representatives, whose work appears in our images and which is not in the public domain.
Our invoices are payable by the specified payment date. Any invoice that remains unpaid after 90 days will attract interest at the current Belgian legal rate, plus a penalty of 15% of the total, with a minimum of 75 euros for administrative costs. These penalties are in addition to any damages or interest or legal costs claimed for copyright violation.
On a case-by-case basis, and on our request, we may authorise SOFAM to represent our moral and pecuniary rights.
Any litigation will be heard in the courts of Brussels under Belgian law.
